Business agreements are established with the aim to have a continuous good relationship between the two parties concerned. To understand more about business agreements, here are some of its aspects:


• The primary aspect of business agreements is the benefits that the relationship is anticipated to give the parties concerned.


• A payment term is one of the aspects of a business agreement that is needed to be carefully treated. The party who will be receiving the payments must make sure that the contract will cover important details like the frequency as well as mode of payment, and the details regarding the remitting party, among others. If a moment of dispute between the two parties occurs, the party who is required to pay might look for a loophole in the business agreement which can be used to withhold payment. For this situation to be avoided, it is better to make sure that the terms in the agreement are tight and closely analyzed.


• The consequences in the incident that a breach of contract occurs should also be clearly specified in the contract. The right of the party injured as well as the consequences, legal jurisdiction which will be applicable, and the liability of the party who breached the contract should also be included.


Tips in Making Good Business Agreements


Here are some guidelines that can be followed in order to make an effective business agreement:


• Keep business agreements simple- It is advisable that an agreement will be created in a short form, having simple as well as clear sentences, and paragraph headings that are numbered so that readers will be alerted what is inside or contained in the paragraph.


• Details should be clearly spelled out- The obligations and rights of both parties should be clearly stated in detail. It is better if there are no specific details which are left out.


• Agree on a manner wherein disputes will be resolved- It is better agree on what you and the other party will do if ever a problem arises. Both of you can decide whether the dispute will be handled through mediation or arbitration instead of taking it to court, which will require money and time.


• Keep the business agreement confidential- When one business acquires another to do a specific service, the latter may receive certain private business information. To protect the secret to be known to others rather the ones who are supposed to know it, the agreement should contain a promise from the two parties to keep sensitive information acquired confidential.


• Agree on the conditions that may terminate the contract- It will be good if the situations that can lead to the termination of the contract will be included.


• Dealing with the right person- Before the negotiation for a business agreement takes place, be sure that the person you are going to negotiate with has the power and authority to bind yours and his/her business together. In addition, that person should also be concerned in making sure that that his/her business will be able to do the specified obligations in the contract.


If the following tips are followed in constructing business agreements, it will be likely that the partnership between the two parties will be fruitful. Building good business agreements may be a tool for a harmonious relationship between the parties involved.
