What's the best way to go about guaranteeing a successful motorcycle compensation claim?

You need to obtain as detailed information regarding the circumstances of the accident as possible. After checking to see if anyone requires medical assistance, the most important thing is to exchange details with the other driver involved if they have stopped, and to get witness statements and details from anyone who was also at the scene of the accident. If the driver did not stop, don't worry, there are still ways to claim your motorcycle compensation. It has been estimated that 75% of motorcycle accidents happen as a result of being hit by another car, and that two thirds of this total were due to negligence on the part of the motorist.

There were 23,714 hit and run cases reported in the UK in 2004 alone and so provision has been set up for anyone to claim for compensation even in these horrific cases. This provision comes in the form of the Motors Insurers Bureau, who deal with claims in cases where a driver involved in an accident is uninsured too. After collecting as many personal details as is possible from the scene, it is then advisable to get as much documentation from and about the scene as possible. This applies especially if the accident was caused by a spillage on the road or as a result of a road defect.

Remember that once you have reported your accident to the police (which should be done within 24 hours) the authority responsible for that road will immediately be informed and will rectify the problem as soon as possible to avoid further injuries, which means a crucial part of your evidence will disappear very quickly if you don't record it.

When you go to record the spillage/defect/accident scene remember to take a witness with you and record the site as you see it, changing nothing. Document the path you were following when the accident occurred using a video camera and where this is not possible draw some detailed diagrams to present to the court. There are many personal injury and road traffic solicitors around, but only some will look to get your motorcycle compensation for every aspect of the fallout from your accident; your financial losses and biker equipment are not always a part of your claim.

It is always best to look for a solicitor who specialises in biking before taking a representative on, that way you can be sure of getting the maximum returns on your claim for example recovering the cost of hiring a new bike, a replacement helmet, loss of earnings and the cost of a physiotherapist. All these could need paying for as a result of a road traffic accident but only a specialist solicitor will push for recovery of these costs at a price that they know to be reasonable.

If you are unsure of which solicitor to choose, contact a specialist claims company (ensuring they will not charge you and you will keep all of your compensation) or your local Citizens Advice Bureau for independent advice regarding all your local representatives.
